Uncontested Divorce at For the People
Uncontested divorce is what we help people with more than anything else. For couples who have resolved their marital asset and debt issues and/or minor children’s issues, For the People can prepare all of the necessary documents for you to obtain your divorce. We also do all of the filing and procedural work for your divorce.
HOW LONG WILL IT TAKE?
Since we are a local company and file hundreds of divorces each year in the Capital District, we can provide you with up to date information about filing fees and the local court systems. The amount of time it will take to have your divorce granted depends, to a certain extent, on what county you are filing in. The caseload varies from county to county and from judge to judge. Please call us so that we may give you approximate filing time frames in the county you wish to file in.
HOW MUCH WILL IT COST?
Our fee to prepare all of your divorce documents is $499.00. Your divorce will be granted in New York State Supreme Court, and the Court has set $335 in filing fees for an uncontested divorce in most NY counties. The filing fees are not due up front – they will be broken up into two separate payments to the County Clerk over the course of your divorce. Our fee is due up front when you are ready to get started and we accept cash, check, credit or debit cards for our fees. The County Clerks will only accept cash, check or money order for filing fees.
HOW DO I GET STARTED?
When you are ready to get started with your uncontested divorce at For the People, you may make an appointment or come in as a walk-in to our office at 133 Wolf Road, Colonie NY. We will have you fill out a set of our divorce workbooks. The workbooks are the way we obtain the information we need about you, your spouse and the issues you need to address in your divorce.
Most of our divorce customers find it takes anywhere from 15 to 30 minutes to fill out the necessary information in our workbooks. You may come in together with your spouse, or you may come in on your own to fill out the workbooks and begin the process. The choice is yours.
For every divorce filed at For the People, we will need simple information such as:
- Both parties’ names, addresses, dates of birth, Social Security numbers
- Whether the parties have marital assets, debts or minor children’s issues to resolve
If you and your spouse have minor children of your marriage, the issues of custody, visitation and child support must be addressed in your paperwork. Therefore, you will need to bring in some additional information including:
- Any Family Court Orders for Custody, Visitation and Child Support
- Income information for both spouses if there is not a Child Support Order from Family Court
- Health Insurance Information for the minor child/children
- Names, dates of birth and Social Security numbers for all minor children of the marriage
If you and your spouse have marital assets and/or debts to be addressed in your divorce documents, you may need to provide the following information:
- Information regarding any pension/retirement or 401K accounts to be divided
- Information on any jointly owned real estate and mortgages including balances and partial account numbers
- Balances and partial account numbers for any jointly held debts
